General Conditions for Puttalyze-App

General Conditions: These General Conditions of Use (hereinafter “General Conditions”) apply to the Puttalyze-App, including its website, mobile applications, and any other related services (hereinafter the “Puttalyze-App”). By using the Puttalyze-App, you agree to be bound by these General Conditions (GC) define the terms of use and the services offered by Puttalyze-App, an application managed by Puttalyze-App (hereinafter referred to as “Puttalyze-App”). They are available on the Puttalyze-App website and are intended to inform the user about the rules of use of the application. By using this application, the user fully and unreservedly accepts these General Conditions.

• The User must have access to the internet and a compatible mobile device (smartphone or tablet) in order to access the Application and use its Services.
• The User acknowledges that the use of the Application is subject to the conditions of access and use of the application store from which it is downloaded (Apple, Google, etc). The User agrees to pay any fees or charges related to the use of the Application.

• Puttalyze-App collects and processes the personal data provided by the User in accordance with its Privacy Policy, available on the Puttalyze-App website. By accepting these General Conditions, the User agrees to the processing of his or her personal data by Puttalyze-App.

Article 7: Liability Puttalyze-App shall not be liable for any direct or indirect damages resulting from the use of the Application or Services.

• Puttalyze-App does not guarantee that the Application and Services will be uninterrupted or error-free.
• Puttalyze-App shall not be liable for any damages resulting from the use of the Application and Services by the User, nor for any damages resulting from the interruption, suspension or termination of the Application or Services.

Article 8: Modification of the General Conditions Puttalyze-App reserves the right to modify these General Conditions at any time, without prior notice.

• The User is bound by the General Conditions in force at the time of use of the Application and Services.

Article 9: Applicable law and jurisdiction These General Conditions are subject to Swiss law. In the event of any dispute arising from the interpretation or execution of these General Conditions, the parties agree to attempt to find an amicable solution. In the event of failure to reach an amicable solution, the dispute shall be submitted to the competent court in accordance with the rules of jurisdiction in force.

• The User agrees to pay the Subscription fees applicable in the currency indicated at the time of purchase.
• The User agrees to provide accurate and complete information about himself and to update it regularly.
• The User agrees not to use the App for any illegal or unauthorized purpose.
• The User agrees not to resell, duplicate or exploit any part of the App, use of the App, or access to the App.
• The User agrees not to interfere or attempt to interfere with the proper functioning of the App.
• The User agrees not to use any robot, spider, other automated devices or manual process to monitor or copy any content from the App without our prior written permission.
• The User agrees not to use any device, software or routine that interferes with the proper functioning of the App.
• The User agrees not to take any action that imposes an unreasonable or disproportionately large load on the App's infrastructure.
• The User agrees not to copy, modify, or distribute any content from the App without our prior written permission.
• The User agrees not to use any part of the App for commercial purposes without our prior written permission.
• The User agrees not to use any content from the App for any purpose other than personal non-commercial use.
• The User agrees that the App may be restricted from time to time due to maintenance, updates or other technical reasons.
• The User agrees to comply with all applicable laws and regulations when using the App.We reserve the right to change these General Conditions at any time, without prior notice. Any changes made will take effect immediately upon publication on the App.
• The User agrees to be bound by any changes made to these General Conditions.

The User undertakes to relieve the Puttalyze-App of any responsibility and to compensate the Puttalyze-App for any damage, claim or costs resulting from the use of the Site or its Services or the violation of these conditions.

• The Puttalyze-App cannot be held liable for the content of third-party websites or services to which the User may have access through a hypertext link, nor for any damage suffered as a result of the use of said content or services.
